Smart Cars of America, LLC (SCOA) or SmartCarWrapping.com (SCW) is not affiliated with, authorized by, associated with or have any connection with G&K, Zap, Mercedes-Benz, Mercedes-Benz AMG, Mercedes-Benz McLaren Mercedes-Benz USA, LLC, smart Canada Division, DaimlerChrysler, Chrysler LLC, DaimlerChrysler AG, Maybach, smart gmbh, a division of Mercedes Benz LLC, the manufacturer of SMART automobiles, smart USA Distributor, LLC, a division of Penske Automotive Group, Inc, the exclusive authorized U.S. importer and distributor of the smart vehicle or any of their official dealerships.

You are prohibited from:

Posting or transmitting any unlawful, threatening, harassing, libelous, defamatory, obscene, scandalous, inflammatory, abusive, hateful, pornographic, or profane material, or any material that could constitute or encourage conduct that would be considered a criminal offense, give rise to civil liability, or otherwise violate any law.

Posting or transmitting material that infringes on the intellectual property rights of others or on the privacy or publicity rights of others.

Engaging in any other conduct that, in Smart Cars of America, LLC or SmartCarWrapping.com (SCW) judgment, restricts or inhibits any other person from using or enjoying the Site, or which, in Smart Cars of America, LLC judgment, exposes Smart Cars of America, LLC or any of its affiliates, employees, contractors, agents, licensors, suppliers, or Content providers to any liability or detriment of any type.

Smart Cars of America, LLC and SmartCarWrapping.com (SCW) will fully cooperate with any law enforcement authorities or court order requesting or directing HRCMG to disclose the identity of anyone posting or transmitting any such information or materials, or otherwise violating the above prohibitions.

You agree to defend, indemnify, and hold Smart Cars of America, LLC or SmartCarWrapping.com (SCW) and its affiliates, employees, contractors, agents, licensors, suppliers, and  Content providers harmless from and against any claims, actions or demands, liabilities and settlements, including, without limitation, reasonable attorneys fees, resulting from, or alleged to result from, your violation of these Terms and Conditions of Use.


JURISDICTION
Smart Cars of America, LLC or SmartCarWrapping.com (SCW) and its affiliates are based in Florida. You expressly agree that exclusive jurisdiction for any dispute with Smart Cars of America, LLC or SmartCarWrapping.com (SCW), or in any way relating to your use of the HRCMG Site, resides in the courts of the State of Florida; and you further agree and expressly consent to the exercise of personal jurisdiction in the courts of the State of California in connection with any such dispute including, without limitation, any claim involving Smart Cars of America, LLC or SmartCarWrapping.com (SCW) and its affiliates, employees, contractors, agents, licensors, suppliers and Content providers.

These Terms and Conditions of Use are governed by the internal substantive laws of the State of Florida, without respect to its conflict of laws principles.
